Everyone should have an estate plan, but a comprehensive legal strategy is especially important when a business and other complex and valuable assets are involved. Estate planning ensures that your medical, personal and financial wishes are clearly expressed.
If an INBLF member firm cannot represent you, that firm will refer you to an attorney who can.
- Trusts: Whatever your particular concerns, the right trust strategy can help. Assets held in a trust avoid the publicity and uncertainty of probate, thus keeping private family matters within the family. Such instruments as revocable trusts, irrevocable trusts, living trusts, special needs trusts, charitable giving trusts, spendthrift trusts and others can be detailed to meet your specific needs.
- Business succession: When you can no longer manage your business, who will? Make sure you have a plan in place for business succession. Talk to an attorney who understands the needs and requirements of family-owned businesses.
- Wills, living wills, health care directives: Even if you have secured specific assets in trust, make sure you have a will to cover all possible issues that may arise absent your ability to decide. A pour-over will can place any outstanding assets into your trust. A living will or health care directive can inform doctors and family members about how you want medical care to be handled if you are unable to make those decisions yourself.
- Powers of attorney: Whether you are traveling out of the country or are unable to make decisions because of incapacity, a power of attorney can allow you to select those who will make necessary decisions about your medical care, your children, your business or your finances.
- Probate and estate administration: When an estate must be settled in probate court, rely on the experience of probate lawyers who work quickly and accurately on behalf of the estate.
