    • Practice includes commercial and intellectual property litigation with an emphasis on trade secret theft, computer fraud, and disputes involving technology companies • Counsels clients on information security and privacy matters, including privacy and security policies, regulatory compliance, data breach response and notifications, and establishing secure electronic commerce systems • Drafts and negotiates technology deals for Silicon Valley technology companies, including software licenses, software development agreements, semiconductor development and sales agreements, Internet service agreements, marketing agreements, reseller agreements, website terms of use, and website privacy policies • Transactional work includes agreements for companies involved in virtual worlds and video games • Advises clients on electronic discovery and digital evidence matters, including document retention and records management policies • Counsels clients concerning liability arising from emerging technologies, such as robotics, autonomous systems, and artificial intelligence • Acts as outside general counsel to Silicon Valley businesses • Organized many corporations and limited liability companies for Silicon Valley entrepreneurs • Chair of the American Bar Association Section of Science and Technology Law from 2010-2011 • From 2001 to 2004 he was Co-Chair of the Section's Information Security Committee • Served on the Section's governing Council from 2004 to 2007 • Lecturer in Law at Santa Clara University School of Law, teaching technology law • Author or co-author of five books: Guide to HIPAA Security and the Law, Information Security: A Legal, Business, and Technical Handbook, Public Key Infrastructure Guidelines, Risk Management for Consumer Internet Payments, and Digital Signatures • Makes frequent presentations on information security, e-discovery, digital evidence, and robotics law topics at numerous industry and continuing legal education conferences • Harvard Law School, Cambridge, Massachusetts, J.D.
